Terms of Service

01Who we are and who these terms are for

ComidaQR is operated by Aniworld Technologies, S.L., Carrer de Mallorca, 401, Bajos, 08013 Barcelona ("we", "us"). These terms form the agreement between us and the business that creates a ComidaQR account ("you", the restaurant).

You must be at least 18 and able to act for the business you register. Diners who open your menu, order or book a table are not parties to these terms. Their use of your menu is between them and your restaurant, and our Privacy Policy explains how their data is handled.

02The service

ComidaQR is a web platform for restaurants. Depending on your plan it includes QR menus in several languages, table ordering, kitchen and staff screens, reservations, printable QR materials, AI menu import and translation, and diner card payments.

Features available on each plan are described on our pricing page and in your account. We improve the service over time and may change or retire features. If a change removes something your paid plan relies on, we will tell you in advance.

03Your account

You sign in through our login provider. Keep access to your account secure and tell us at legal@comidaqr.com if you think someone else has used it. You are responsible for what happens under your account, including what your staff do with the access you give them.

Give us accurate details and keep them up to date, especially your contact email: we use it for service notices.

04Free trial

New accounts can start with a free trial. It lasts 14 days unless the plan you choose states another length. No card is needed to start.

We email you before the trial ends and when it ends. When it ends without a subscription, your public menu, ordering and booking pages stop working until you subscribe. Your account and data stay in place.

05Plans, billing and cancellation

Paid plans are billed in advance through Stripe and renew automatically at the end of each billing period until cancelled. Prices are shown before you subscribe and include or exclude VAT as stated there.

You can cancel at any time from the subscription page in your account or the Stripe billing portal. Cancellation takes effect at the end of the period you have paid for. If a payment fails, we may pause the public parts of your account until it is resolved.

Fees already paid are not refunded, except where the law requires it or we agree otherwise in writing.

06Diner payments

If you turn on diner payments, payments are processed by Stripe through Stripe Connect. You will need a Stripe account and must accept Stripe's terms. Stripe pays the funds out to your bank account.

ComidaQR keeps a platform fee on each diner payment. The fee is shown in your payment settings before you activate diner payments. When you refund a diner, the platform fee is reversed in proportion.

You remain responsible for your prices, the food and drink you serve, the taxes on your sales and the receipts you owe your diners.

07Your content

Menus, dish names, descriptions, prices, photos and other material you add stay yours. You give us permission to host, copy, translate, display and transmit that material only as needed to run the service for you, including showing your menu to diners.

You are responsible for your content being accurate and lawful, including allergen information. Translations and menu imports produced with AI are drafts: check them before you publish.

08Acceptable use

Do not use ComidaQR to break the law, to publish content that infringes others' rights, to send spam, to interfere with the service or its security, to access accounts that are not yours, or to resell the service without our written permission.

We may suspend an account that breaks these rules or puts other customers or diners at risk. Where we can, we will tell you first and give you a chance to fix the problem.

09Our platform

The software, design and brand of ComidaQR belong to us or our licensors. These terms give you the right to use the service, not ownership of it. Do not copy, modify or reverse-engineer it except where the law allows.

10Personal data

For the data of your diners and staff that passes through ComidaQR, you are the controller and we act as your processor. Our Data Processing Agreement applies and forms part of these terms. Our Privacy Policy explains how we handle the personal data we control.

11Availability and liability

We work to keep ComidaQR available but cannot promise it will never be interrupted. Maintenance, failures of our providers or events beyond our control can cause downtime.

Nothing in these terms limits liability that cannot be limited by law, such as for intent or gross negligence. Otherwise, we are not liable for indirect losses such as lost profits, and our total liability in any twelve months is limited to the fees you paid us in those twelve months.

12Ending the agreement

You can stop using ComidaQR and cancel your subscription at any time. We may end these terms with 30 days' notice, or straight away if you seriously break them.

Your data remains available to export until you delete your account. When you ask to delete it, deletion is scheduled for 30 days later and you can cancel it during that time. Our Privacy Policy explains what is deleted and what the law requires us to keep.

13Changes to these terms

We may update these terms. For material changes we will email you before they take effect. If you do not agree, you can cancel before the new terms apply.

14Law and disputes

These terms are governed by Spanish law. The courts of Barcelona have jurisdiction, unless the law gives you the right to go to another court.
